2.1 Product Use: eBikeling products, including but not limited to electric bike conversion kits, are designed for retrofitting bicycles. They must be installed and used as per the provided guidelines and local regulations.

2.2 Eligibility: By purchasing from eBikeling, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

2.3 Agreement to Terms: By accessing our website or purchasing our products, you agree to be bound by these terms and any updates made to them.

2.4 Prohibited Uses:

Customers must not:

  • Modify or tamper with eBikeling products in a manner inconsistent with provided guidelines.

  • Use products for unlawful purposes or in violation of local, state, or federal regulations.

  • Attempt to reverse-engineer or replicate eBikeling products without written consent.

 


 

3. Safety Warnings and Guidelines

3.1 Assumption of Risk: Customers acknowledge that modifying or converting bicycles inherently involves risks, including but not limited to accidents, injuries, and property damage. By purchasing our products, you assume all risks associated with their use.

3.2 User Responsibility:

Customers must:

  • Conduct pre-use safety checks, including ensuring all components are securely installed.

  • Wear appropriate protective gear, such as helmets and reflective clothing, while using electric bicycles.

  • Avoid operating modified bicycles under adverse weather or hazardous conditions.

3.3 Battery and Electrical Component Use:

  • Follow all safety guidelines for charging, storing, and using batteries.

  • Use only eBikeling-approved batteries and chargers to avoid risks such as fire, explosion, or injury.

  • Never expose batteries to extreme temperatures, moisture, or physical damage.

 


 

4. Liability Disclaimer

4.1 Customer Responsibility: By purchasing and using eBikeling products, you acknowledge and agree to the following:

  • You accept full responsibility for the proper installation, maintenance, and safe use of our products.

  • You agree to adhere to electric bike safety and operational guidelines by US Federal and State Laws.

  • You understand that compliance with local, state, and federal laws and regulations regarding electric bicycles is your responsibility.

  • You accept full liability for any accidents, injuries, property damage, or losses, including but not limited to battery explosions, fires caused by batteries or chargers, or other incidents resulting from the use, misuse, or improper handling of eBikeling products or using components, parts, or accessories that are not provided by eBikeling. By purchasing, installing, or using eBikeling products, you explicitly acknowledge and agree to assume full responsibility for any consequences, including accidents, injuries, property damages, or incidents arising from, but not limited to, battery explosions, fires caused by batteries or chargers, or improper usage. Customers understand and agree that ensuring the safe and proper use of eBikeling products is entirely their responsibility, including adhering to safety guidelines, using approved components, and complying with local regulations. By using our products, you accept the inherent risks involved and fully absolve eBikeling of any liability for such events. This includes agreeing that eBikeling shall not be held responsible for any damages or losses resulting from improper installation, negligence, failure to follow provided guidelines, or the use of unauthorized third-party components.

  • By using our products, you acknowledge the inherent risks involved and agree that eBikeling is not responsible for any damages or losses resulting from improper installation, failure to follow safety guidelines, or negligence.

4.2 Third-Party Components: eBikeling is not liable for any damages, injuries, or losses caused by using third-party components (e.g., batteries, chargers) with our products. Customers accept full liability for any consequences resulting from such use.

4.3 Limitation of Liability: To the fullest extent permitted by law, eBikeling disclaims liability for:

  • Any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our products.

  • Any accidents, injuries, fires, or damages caused by misuse, improper installation, or negligence in using eBikeling products.

 


 

5. Warranty and Returns

5.1 Warranty Period: All eBikeling conversion kits, ebike motors, and batteries come with a 1-year and all components and accessories come with a 3-month limited warranty from the date of delivery. This warranty covers manufacturing defects but excludes damages caused by:

  • Improper installation or use.

  • Third-party components.

  • Modifications to the product.

5.2 Activation of Warranty: To activate the warranty, customers must submit a post-installation form, including photos or videos of the installed kit, for review by our technical team.

5.3 Returns and Refunds:

  • Unused products can be returned within 14 days of delivery for a refund, excluding shipping and restocking fees.

  • Products returned must be in new, unused condition, with all original packaging.

  • Refunds for faulty goods will be processed upon inspection and confirmation of a manufacturing defect.

5.4 Exclusions: The warranty does not cover normal wear and tear, cosmetic damages, or issues arising from non-compliance with installation or usage instructions.

 


 

6. Taxes, Duties, and Shipping

6.1 Taxes: Prices displayed include applicable taxes unless otherwise specified. Customers outside the U.S. may be required to pay local taxes and import duties upon delivery.

6.2 Shipping:

  • Orders are shipped within 1 business day of payment confirmation unless additional information is required by the buyer.

  • eBikeling is not responsible for delays caused by customs, carrier issues, or unforeseen circumstances.

6.3 Lost or Damaged Shipments:

  • Customers must report lost or damaged shipments within 7 days of delivery.

  • eBikeling will assist in filing claims with carriers but does not guarantee reimbursement for losses.

 


 

7. Pre-Orders and Custom Orders

7.1 Pre-Order Policy: Pre-orders are a deposit to secure your kit at the stated discount. Once manufacturing begins, cancellations may not be accepted.

7.2 Custom Orders: Custom configurations are non-refundable once production has started.

 


 

8. Privacy Policy

8.1 Data Collection: eBikeling collects personal information necessary for processing orders, providing support, and improving customer experience. This includes but is not limited:

  • Name, contact information, location information, device and browser information, and payment details.

  • Usage data from our website.

10. Force Majeure

10.1 Definition: eBikeling is not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to natural disasters, labor disputes, government actions, or interruptions in supply chains.

10.2 Customer Options: In such events, customers may:

  • Accept delayed fulfillment of their order.

  • Request a refund for unshipped products.

 


 

11. Governing Law

These terms and conditions are governed by the laws of the State of Illinois, United States. Any disputes arising under or in connection with these terms shall be resolved in the courts located in Cook County, Illinois.

 


 

12. Dispute Resolution

12.1 Mediation and Arbitration:

  • Before pursuing legal action, customers agree to engage in good faith mediation to resolve disputes. Mediation shall be conducted by a mutually agreed upon neutral mediator and both parties shall equally share the costs of mediation.

  • If mediation fails, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Cook County, Illinois, and the decision of the arbitrator shall be final and binding on both parties. Both mediation and arbitration proceedings shall remain confidential, and each party shall bear its own legal fees and costs unless otherwise determined by the arbitrator.
